APPEAL COURT DISMISSES SUIT FILED BY DAVID MARK’S ADC FACTION

The Court of Appeal sitting in Abuja has dismissed an appeal filed by the African Democratic Congress (ADC)

and it’s factional leaders led by national chairman David Mark.

The appeal is on the factional leadership tussle in its Abia State branch, on who had the jurisdiction to conduct state party congresses.

In a two- to- one decision, an appeal court panel led by Justice Okon Abang held that the Abia State branch had powers to conduct state congresses to choose its state party leaders.

But, in a dissenting judgment, Justice Abba Mohammed held that it was an internal party affair of the ADC, therefore not justiciable.

The dissenting judgment noted that the ADC had held its convention and state congresses, before the trial court made it’s order to stop the convention.

The minority judgement accordingly allowed the appeal by the David Mark faction, and set aside the trial court’s jurisdiction over it.
