COURT DISMISSES STAY OF EXECUTION BID BY ENUGU PSYCHIATRIC HOSPITAL MEDICAL DIRECTOR

The National Industrial Court sitting in Abuja has dismissed an application seeking a stay of execution of its judgment that removed the Medical Director of the Federal Neuropsychiatric Hospital, Enugu, Dr. Ngozi Unaogu, from office and ordered the reinstatement of Professor Monday Igwe.

Justice Emmanuel Subilim dismissed the application filed by Dr. Unaogu seeking to halt the implementation of the court’s earlier judgment delivered on December 11, 2025.

The court had in the judgment ordered the immediate reinstatement of Professor Monday Igwe as Medical Director of the Federal Neuropsychiatric Hospital, Enugu, to enable him complete his tenure, which it held was unlawfully terminated.

In his ruling on the stay application, Justice Subilim held that the balance of convenience must be applied in favour of preserving the rights of the respondent to complete his lawful tenure.

The judge maintained that granting the stay would cause irreparable damage to Professor Igwe, as time lost from his tenure could not be recovered.

Justice Subilim said the essence of the court’s order was to preserve the respondent’s right to serve out the remaining period of his appointment.

The National Industrial Court had earlier ruled that Professor Monday Igwe’s removal from office was unlawful and directed his reinstatement as Medical Director of the Federal Neuropsychiatric Hospital, Enugu.
